The 1870 Codigo Penal de España or Penal Code of Spain of 1870 was in force in the Philippines up to 31 December 1931.[1] While many of the offenses contained in the old Penal Code remains the same in the Revised Penal Code, the old Penal Code did not contain certain provisions, including:
- Vagrancy. The first statute punishing vagrancy – Act No. 519 – was modeled after American vagrancy statutes and passed by the Philippine Commission in 1902.[2]
Act No. 3185, which took effect on 1 January 1932, revised and superseded the old Penal Code.
